Terms and Conditions of Sale

Last updated: 21 July 2026

1. Identification of the seller

The website flirtstores.fr is operated by:

Thomas Macri, sole trader, trading under the name Flirt
SIREN: 100 836 634
SIRET: 100 836 634 00012
Registered with the French National Business Register
Address: 8 Lotissement les Cistes, Chemin des Salles, 83300 Draguignan, France
Email: contact@flirtstores.fr
Telephone: 06 23 83 92 01

In these Terms and Conditions of Sale, the seller is referred to as “Flirt” and any person making a purchase on the website is referred to as the “customer”.

2. Purpose and scope

These Terms and Conditions of Sale govern the sale of clothing, fashion accessories and other pre-owned items offered on flirtstores.fr.

They apply to every order placed by a consumer acting for purposes outside their trade, business, craft, profession or agricultural activity.

By confirming an order, the customer acknowledges that they have read and accepted these Terms and Conditions of Sale.

The applicable Terms are those available on the website when the order is placed. Flirt may amend them at any time, but new provisions will not apply retrospectively to orders that have already been confirmed.

3. Product characteristics

Flirt primarily sells pre-owned clothing and accessories. Unless otherwise stated, products are therefore not new and may show signs of use, age or wear consistent with their nature as second-hand items.

The essential characteristics of each product are stated on its product page, including its brand, type, size, colour, condition, any visible defects and, where this information is available, its measurements and composition.

The customer must carefully review the description and photographs before ordering. Signs of use, particular characteristics or defects expressly stated on the product page do not constitute a lack of conformity discovered after purchase.

Photographs are taken to represent products as faithfully as possible. Slight colour variations may nevertheless occur depending on the lighting used and the customer's screen settings.

Sizes shown on labels may vary according to the brand, country and period of manufacture. Where measurements are provided, the customer should compare them with those of a garment that fits them.

4. Unique items and availability

Most products offered by Flirt are unique pieces available in a single quantity.

Adding a product to the basket does not reserve it. The product remains available for sale until the order has been confirmed and paid for.

In the exceptional event that the same item is ordered simultaneously by several customers, priority will be given to the order whose payment was confirmed first.

If an ordered product becomes unavailable after the order has been confirmed, Flirt will inform the customer as soon as possible and refund the sums paid for the unavailable product. Because the items are unique, replacement with an identical product is generally not possible.

5. Prices

Prices are stated in euros. The applicable price is the price displayed on the product page when the order is confirmed.

Delivery charges are not included in the product prices. They are calculated according to the destination, delivery method, parcel weight and dimensions, and are displayed before the order is finally confirmed.

The total amount payable, including the product price and delivery charges, is shown to the customer before payment.

Any promotions are valid for the period stated and while stocks last. Unless otherwise indicated, multiple promotional codes cannot be combined on the same order.

In the event of an obvious pricing error resulting, in particular, from an IT issue or data-entry error, Flirt may contact the customer and offer them the choice of confirming the order at the correct price or cancelling it for a full refund.

6. Ordering process

The customer selects the products they wish to purchase and adds them to their basket.

Before payment, an order summary enables the customer to check the selected products, quantities, prices, delivery charges, address provided and total order amount.

The customer must correct any error before confirming the purchase. They are responsible for the accuracy of the information they provide.

The order becomes final once payment has been confirmed and the order confirmation email has been sent, subject to the actual availability of the products and any anti-fraud checks that may be carried out.

Flirt may refuse or cancel an order in the event of a declined payment, reasonable suspicion of fraud, manifestly incorrect information, product unavailability or a previous unresolved payment dispute with the customer.

7. Payment

Payment is made using one of the methods offered when the order is placed.

The payment methods actually available may include bank card, PayPal or any other service activated on the website.

The order is payable in full when it is confirmed, except where an instalment payment solution is expressly offered to the customer.

Transactions are processed by the secure payment providers used by Shopify and by the other payment services offered at checkout.

If payment is declined, the order is not confirmed.

8. Order confirmation and proof

Once the order has been confirmed, the customer receives an order confirmation at the email address provided.

This confirmation contains the main information relating to the purchase. The customer should check their junk or spam folder if they do not receive it.

The data recorded by the website, Shopify and the payment providers constitutes evidence of the order and the transactions carried out, subject to any contrary evidence admissible by law.

9. Preparation and delivery

Orders are prepared and shipped to the address or collection point selected by the customer.

The available delivery methods and destinations, charges, estimated timeframes and tracking arrangements are set out in the Shipping Policy available on the website.

Flirt will deliver the goods on the date or within the period stated to the customer. Where no specific period is stated, delivery will take place without undue delay and no later than thirty days after the contract is concluded.

Carrier transit times remain estimates where they depend on the carrier, without prejudice to the customer's rights in the event of delayed delivery.

The customer must provide a complete and accurate address. Once the parcel has been handed to the carrier, it may no longer be possible to change the address.

If a parcel is returned to Flirt because the customer provided an incorrect or incomplete address or failed to collect it within the period specified by the collection point, a new shipment may be subject to payment of additional delivery charges.

10. Transfer of risk

Where the carrier is offered by Flirt, the risk of loss or damage remains with Flirt until the customer, or a third party designated by the customer, takes physical possession of the order.

Where the customer entrusts delivery to a carrier they selected themselves and which was not offered by Flirt, risk transfers when the parcel is handed to that carrier.

If a parcel is lost or damaged in transit, the customer must contact Flirt at contact@flirtstores.fr so that the necessary checks can be carried out.

11. Right of withdrawal

In accordance with the French Consumer Code, the customer has fourteen days in which to exercise their right of withdrawal without having to give a reason.

This period begins on the day after the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.

Where the same order includes several goods delivered separately, the period begins upon receipt of the final item.

To meet the deadline, the customer must inform Flirt of their decision before the period expires by means of a clear and unambiguous statement.

The request may be sent by email to contact@flirtstores.fr or by post to the following address:

Thomas Macri – Flirt
8 Lotissement les Cistes
Chemin des Salles
83300 Draguignan
France

The customer may use the model withdrawal form provided at the end of these Terms, but its use is not mandatory.

12. Return following withdrawal

After communicating their decision to withdraw, the customer must return the product without undue delay and no later than fourteen days after that communication.

The direct cost of a return made as part of an ordinary withdrawal remains the customer's responsibility.

The product must be returned complete, in the condition in which it was received and adequately protected for transport.

The customer may handle or try on the product to the extent necessary to establish its nature, characteristics, size and condition. The customer may, however, be held liable for any loss in value resulting from handling beyond what is necessary for those checks.

In particular, an item must not have been worn for a prolonged period, washed, altered, damaged, stained, perfumed or returned with components missing.

The customer must retain proof of dispatch of the return until their request has been resolved.

13. Refund following withdrawal

Where the withdrawal concerns the entire order, Flirt will refund the sums received, including the original standard delivery charges.

Where the customer chose a delivery method more expensive than the standard option offered, the additional cost resulting from that choice will not be refunded.

Where the withdrawal concerns only part of the order, the price of the returned products will be refunded. The original delivery charges will be refunded only where they would have been lower had the returned products not been included in the order.

The refund will be made no later than fourteen days from the date on which Flirt is informed of the decision to withdraw.

Flirt may withhold the refund until the products have been recovered or until proof of their dispatch is received, whichever occurs first.

The refund will be made using the same payment method used for the order, unless the customer expressly agrees to another method that does not incur any fees for them.

14. Exchanges

As products are generally unique pieces, Flirt cannot guarantee that an item can be exchanged for the same model in another size, colour or condition.

The customer may exercise their right of withdrawal under the conditions above and then, if they wish, place a new order for another available item.

15. Incorrect, damaged or non-compliant product

If a customer receives a product that differs from the one ordered, was damaged in transit or does not match the stated description, they must contact Flirt as soon as they become aware of the issue at contact@flirtstores.fr.

The customer must state their order number and, where possible, provide photographs showing the issue.

This procedure facilitates the handling of the request but does not deprive the customer of the statutory guarantees and time limits provided by law.

Where the error, damage or lack of conformity is attributable to Flirt or to a carrier offered by Flirt, the necessary return costs will not be borne by the customer.

16. Statutory guarantees

The statutory guarantees are provided by:

Thomas Macri – Flirt
8 Lotissement les Cistes, Chemin des Salles, 83300 Draguignan, France
Telephone: 06 23 83 92 01
Email: contact@flirtstores.fr

Products sold by Flirt benefit from the statutory guarantee of conformity provided for in Articles L. 217-1 to L. 217-32 of the French Consumer Code and the statutory guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.

Information concerning statutory guarantees

The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity where a lack of conformity appears.

For pre-owned goods, a lack of conformity appearing within twelve months of delivery is presumed to have existed at the time of delivery, unless proven otherwise or unless that presumption is incompatible with the nature of the goods or the defect. After this twelve-month period and for the remaining duration of the guarantee, the consumer may still make a claim but may be required to demonstrate that the defect existed at the time of delivery.

The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without significant inconvenience to them.

Because the products sold by Flirt are pre-owned and often unique, repair or replacement with an identical item may be impossible or may involve disproportionate costs. The available remedies will then be determined in accordance with the applicable legal provisions.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair but the seller requires replacement, the statutory guarantee of conformity is renewed for a period of two years from the replacement.

The consumer may obtain a price reduction while keeping the goods, or terminate the contract and receive a refund in exchange for returning the goods, where the trader refuses to bring the goods into conformity, where conformity is achieved more than thirty days after the request, where it causes significant inconvenience or where the lack of conformity persists despite an attempt to bring the goods into conformity.

The consumer may also obtain an immediate price reduction or termination of the contract where the defect is sufficiently serious. The sale cannot, however, be terminated where the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. The consumer has two years from discovery of the defect in which to bring a claim.

Under the guarantee against hidden defects, the consumer may choose either to return the goods and obtain a refund of the price or to keep the goods and obtain a price reduction.

The statutory guarantee of conformity does not cover a characteristic or defect that was clearly described and accepted at the time of purchase, or deterioration resulting from inappropriate use, an accident, alteration, improper care or normal wear occurring after delivery.

Flirt does not offer any additional commercial guarantee unless expressly stated otherwise on the product page or in a document provided to the customer. The absence of a commercial guarantee does not in any way limit the statutory guarantees.

17. Liability

Flirt is responsible for proper performance of the obligations arising from the contract under the conditions provided by law.

Flirt cannot, however, be held liable for damage resulting from misuse of the product, failure to follow its care instructions, alteration after delivery or use that is inconsistent with the product's normal purpose.

Nothing in these Terms may exclude or limit any mandatory right granted to the consumer by law.

18. Force majeure

Neither party may be held liable for a failure directly caused by an event constituting force majeure under French law.

The affected party must inform the other party as soon as possible. Where the impediment is temporary, performance of the obligation is suspended unless the delay justifies termination of the contract in accordance with the law.

19. Personal data

Personal data collected when an order is placed is used to manage purchases, payments, deliveries, customer service, returns, fraud prevention and Flirt's legal obligations.

The arrangements governing collection, use, retention and the exercise of customer rights are set out in the Privacy Policy available on the website.

20. Intellectual property

The content of flirtstores.fr, including its texts, photographs, logos, graphic elements and presentations, is protected by the applicable intellectual property laws.

Any unauthorised reproduction, use or distribution of this content is prohibited, subject to the exceptions provided for by law.

21. Complaints

For any question or complaint relating to an order, the customer must contact Flirt and state their order number:

Email: contact@flirtstores.fr
Telephone: 06 23 83 92 01
Post: Thomas Macri – Flirt, 8 Lotissement les Cistes, Chemin des Salles, 83300 Draguignan, France

Flirt will endeavour to find an amicable solution with the customer.

22. Consumer mediation

In accordance with the provisions of the French Consumer Code concerning the mediation of consumer disputes, after first contacting Flirt in writing and failing to receive a satisfactory response, the consumer may use the following mediation service free of charge:

CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu
75008 Paris
Telephone: 01 89 47 00 14
Email: litiges@cm2c.net
Online referral: https://www.cm2c.net/declarer-un-litige.php

Referral to the mediator requires the consumer first to have submitted a written complaint to Flirt and the dispute not to have been resolved directly.

23. Governing law and dispute resolution

These Terms and Conditions of Sale and contracts concluded through the website are governed by French law.

Where the customer resides in another country, this provision does not deprive them of the mandatory protections available under the law applicable in their country of residence.

If no amicable resolution or successful mediation is achieved, the dispute may be brought before the competent courts in accordance with the applicable legal rules.

24. Severability

If any provision of these Terms is declared void, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
